Privacy, Terms and Conditions.

Let's keep it simple:

When we collect your data on this site, we store it securely ONLY inside Wix's password protected database, our secure Google storage, or locally on one physical machine: your information is secure.

If we send you e-mails or messages, they may occasionally be sent via a Yahoo password protected e-mail system.

We do not spam prospective clients with excessive marketing information.

We will never share your data with anybody outside Eccleshall Websites.

We will only contact you regarding our own products and services in direct relation to your reason for contacting us.

If you no longer wish to hear from us, simply reply to any of our e-mails with 'unsubscribe', and you will be removed from our marketing emails.

Website and Marketing Services Terms and Conditions
(These do not apply to the 'Simple Pro' offer.)

Welcome to our website and marketing services! We're thrilled to embark on this digital journey with you. Here’s a friendly guide to ensure our collaboration sails smoothly:

Deposit and Payments:

Once we kick off your website project, a 50% deposit is required. This deposit is non-refundable as it covers the initial costs of our creative process. Upon completion of your website, the remaining balance will be due. It’s like booking a concert ticket for your brand’s performance – commitment is key!

Your Vision, Our Mission:

We’re here to bring your digital dreams to life. To ensure we hit the mark, please communicate any tweaks or changes you envision along the way. We’re all ears!

Project Completion:

We will do our utmost to complete your project with the information provided to us. You commit to providing us with everything we need to produce your website in a timely manner, before we begin the build.  If we begin or complete the build and extra information or content is then provided, extra charges may be incurred.  Any delays caused by the client (you) which are outside of our control may mean the closing balance is invoiced and payment requested, in order that the 30 day grace period can begin.

Extra Features, Extra Charge:

Dreaming of additional functionalities or elements not discussed in our initial chat? No problem! Just note, these will incur additional charges. It’s a bit like customizing a car; the base model is fantastic, but those extra features will cost a bit more.

30-Day Grace Period:

After the final invoice, you will have a 30-day window to request any final adjustments, on the house. Consider this your digital test drive. After this 30 day period, any further work will incur a charge on a job-by-job basis.

Ownership and Hosting:

Once the project concludes and all payments are settled, the digital keys are yours. As with all webssites, you will need to pay hosting fees.  Wix starts at £10.50pcm at the time of writing, Shopify starts at £28pcm at the time of writing, but prices may vary.

Feasibility and Flexibility:

Our goal is to fulfill your website wishlist. However, sometimes the digital tools at our disposal have limitations. If a requested feature is not feasible within the chosen platform, or if bespoke coding beyond our initial scope is needed, we’ll discuss alternative solutions or additional costs.

Platform Limitations:

The digital world has its boundaries, and sometimes we must navigate within them. We’ll always aim for the moon with your design, but on rare occasions, we might have to settle for the stars due to platform constraints.

Commitment to Completion:

By placing your deposit, you’re not just investing in a website; you’re pledging to partner with us to cross the finish line together. You commit to ensuring you provide all necessary content (images, text, product details, etc.) in a timely and organized manner to avoid project delays.

Content Responsibility:

Your website needs to mirror your brand perfectly, which means you’re in charge of supplying the content. A smooth delivery from your end enables a swift creation on ours.

Sales and Conversions:

While we promise to pour our heart and skill into your project, the digital market is unpredictable. We can’t guarantee your audience will hit the 'buy' button, but we'll do our best to make your offerings as irresistible as possible.

We're on this journey together, and we're committed to making your digital presence as impactful as possible. Thank you for choosing us to bring your vision to life!

By proceeding with our services, you acknowledge and agree to these terms. Here's to a successful partnership and an outstanding online presence!

Contact: info@eccleshallwebsites.co.uk

2) What these Terms cover

These Terms govern your purchase, access, and use of our digital downloads (e.g., PDFs, e-books, guides, templates, and any accompanying files or bonuses) (the “Digital Content”).

3) Ordering & payment

  • Prices are shown in £ and exclude VAT.

  • We accept the payment methods displayed at checkout.

  • An order is accepted when we email your download link or otherwise make the Digital Content available.

4) Delivery of digital content

  • Delivery is by instant download link or email to the address you provide at checkout.

  • Links may be time-limited and/or limited to a reasonable number of downloads to prevent abuse.

  • Please save a copy to your device promptly and keep a backup.

5) Licence and permitted use

When you purchase, you receive a personal, non-exclusive, non-transferable licence to use the Digital Content for your own individual use only. You must not:

  • Share, resell, sub-licence, publish, upload, post publicly, or distribute the Digital Content or any substantial part of it.

  • Remove copyright notices or attempt to claim the content as your own.

  • Use the Digital Content to create competing products or upload it to datasets or tools for AI model training.
All intellectual property rights remain with us (or our licensors).

6) Important disclaimers (please read)

  • The Digital Content is educational/informational. It is not financial, legal, tax, or investment advice.

  • We do not provide regulated financial services. Always do your own research and seek professional advice where appropriate.

  • Results vary. Your outcomes depend on your skills, effort, market conditions, compliance with laws and platform rules, and other factors beyond our control.

7) Your statutory rights & cancellation

  • Under the UK Consumer Contracts Regulations, your 14-day cancellation right does not apply once downloading/streaming of digital content begins if you gave express consent to immediate supply and acknowledged this means losing the right to cancel. Our checkout captures this consent.

  • This does not affect your statutory rights regarding faulty content. If the file is defective or not as described, contact us and we will repair, replace, or refund as required by law.

8) Our Success Guarantee – full refund if unsuccessful after a proper try

We want this to be genuinely useful. In addition to your statutory rights, we offer a Success Guarantee:

What we promise
If you properly try at least one option from the guide and do not achieve a meaningful result, we will refund 100% of the purchase price.

What counts as a “proper try” (fair and reasonable standard):

  1. Follow the steps: You selected an option from the guide and followed the steps as written (including any setup, safety, and compliance notes).

  2. Give it a fair run: You pursued the option consistently for at least [e.g., 14 days] (or a shorter period if the guide states the option can be tested faster), making a reasonable number of attempts appropriate to that option.

  3. Keep basic evidence: You kept reasonable evidence of your attempts, such as: screenshots of listings/posts/ads/profiles; timestamps; short notes/logs of actions taken; messages/emails with prospects; basic metrics (impressions, clicks, enquiries, etc.). We are not asking for anything burdensome—just enough to show a real attempt.

  4. Stay within the rules: You complied with applicable laws and relevant platform rules (e.g., marketplace/advertising/community guidelines).

How to claim
Email info@eccleshallwebsites.co.uk within 30 days of purchase with:

  • Your order number and the email used at checkout.

  • A brief summary of the option you chose and what you did.

  • A few pieces of reasonable evidence as described above.

We’ll review promptly and, if the above is met, issue a full refund to your original payment method within 14 days. One refund claim per customer per product. We may also offer friendly tips before issuing the refund, but help is optional—you never have to accept additional support to receive your refund if you’ve met the criteria.

Fair use
We reserve the right to refuse a claim only where there is clear evidence of abuse (e.g., file-sharing, multiple purchases under different emails, or fabricated evidence). This guarantee is designed to be consumer-friendly and will be applied in good faith.

9) Technical support

If your file is corrupted, the link fails, or you experience access issues, contact info@eccleshallwebsites.co.uk and we’ll re-send or provide an alternative download method.

10) Updates

From time to time we may update the Digital Content to improve accuracy or usefulness. Where feasible, we may provide minor updates to existing purchasers at no extra cost. Major revisions or new editions may be charged separately.

11) Prohibited conduct

You agree not to use the Digital Content:

  • For unlawful purposes or to infringe any third-party rights.

  • To mislead others or make false claims about earnings or outcomes.

  • In any way that could damage our reputation or the reputation of others.

12) Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under law.
Subject to that, we are not liable for: (a) indirect or consequential loss; (b) loss of profits, revenue, business, or data; (c) events beyond our reasonable control. Our total liability arising out of or in connection with the purchase or use of the Digital Content will not exceed the amount you paid for that Digital Content.

13) Privacy

We process personal data in accordance with our Privacy Policy (see [link to privacy policy]). We use your details to fulfil your order, provide support, and—if you opt in—send updates and marketing. You can opt out at any time.

14) Age and capability

You confirm you are at least 18, or have the consent of a parent/guardian, and are legally capable of entering into a binding contract.

15) Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your order applies to that purchase.

16) Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, unless another mandatory law applies.
